Thank you for being a participant at an event or workshop at The Painting Barn, LLC! Whether a child or adult participant, there are certain rules and regulations you must abide by to make this an enjoyable experience for everyone. Therefore, by signing this waiver, you agree to be bound by the following terms and conditions:

For adult participants, by typing "YES"  you agree to the following rules and regulations:

​

1. As a participant, I understand that I will use or be exposed to drills, hammers, mallets, nails, sandpaper, paint and oil-based stains during The Painting Barn, LLC workshops.

​

2. I also understand that there may be certain risks involved in participating in The Painting Barn workshops.  I agree to take precautions and observe all The Painting Barn, LLC policies, recommendations, directions, rules, and warnings; whether provided orally or in writing.  I assume full responsibility for personal injury to myself.

3.  I further agree to release and discharge The Painting Barn, LLC for any injury, loss or damage that may arise out of my participation in a workshop and/or my presence in The Painting Barn, LLC facilities whether caused by me, The Painting Barn, LLC, or any third party.

4.  I agree to indemnify and defend The Painting Barn, LLC against all claims, causes of action, damages, judgments costs or expenses including reasonable attorney's fees and other litigation costs which may in any way arise from my participation in The Painting Barn, LLC workshops or my presence in The Painting Barn, LLC facilities.

5.  Participant acknowledges that The Painting Barn, LLC will not supply alcohol to participants.  However, participants, in their sole discretion, may elect to consume alcohol during a workshop.

6.  In the event that alcohol is consumed at a workshop by a participant that participant agrees to assume the risks associated with alcohol consumption and agrees to take full responsibility for his or her own actions, safety and welfare.

7.  Participant agrees to exercise ordinary and reasonable care at all times, and to not consume alcohol to the extent that participant's judgment is impaired. Participant also agrees that The Painting Barn, LLC reserves the right to cease a participant's involvement in a workshop at its sole discretion.

8.  I further agree to release and discharge The Painting Barn, LLC for any injury, loss or damage that may arise out of my alcohol consumption during a workshop, including my travel to and from a workshop.

For child participants, a parent or legal guardian must agree to the following rules and

regulations. By typing "YES", you agree to be bound by the following with respect
to the child participant:

1. As a participant, I understand that my child will use and/or be exposed to drills, hammers, mallets, nails, sandpaper, paint and oil-based stains during The Painting Barn, LLC workshops.

2. I also understand that there may be certain risks involved in participating in The Painting Barn workshops.  I agree to take precautions and observe all The Painting Barn, LLC policies, recommendations, directions, rules, and warnings; whether provided orally or in writing. I assume full responsibility for personal injury to myself as well as to my child participant.

3. I further agree to release and discharge The Painting Barn, LLC for any injury, loss or damage that may arise out of my participation or my child’s participation in a workshop and/or my presence in The Painting Barn, LLC facilities whether caused by me, The Painting Barn, LLC, or any third party.

4. I agree to indemnify and defend The Painting Barn, LLC against all claims, causes of action, damages, judgments costs or expenses including reasonable attorney’s fees and other litigation costs which may in any way arise from my participation or my child’s participation in The Painting Barn, LLC workshops or my
presence in The Painting Barn, LLC facilities.

5. I agree that it is my responsibility to monitor the child participant and their activities during the event in order to ensure that rules and regulations are followed. I understand that The Painting Barn, LLC reserves the right to cease a child participant’s involvement in a workshop at its sole discretion.

PHOTO RELEASE

1. I hereby grant The Painting Barn, LLC permission to use my likeness in a photograph, video, or other digital media (herein “photo”) in any and all of its advertising or social media, without payment or other consideration.

 

2. I understand and agree that all photos will become the property of The Painting Barn, LLC and will not be returned to me.

 

3. I also authorize The Painting Barn, LLC to edit, alter, copy, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. I also waive compensation related to the use of the photo(s).

 

4. I hereby hold harmless and forever discharge The Painting Barn, LLC from all claims or causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf may have by reason of this authorization.
